Rules for Buying Tea from Our Gardens

These terms explain the rules when you order tea from AssamSip. By placing an order, you agree to follow these conditions. Please read carefully before ordering. Last updated: January 10, 2025.

Which Laws Apply to Our Tea Business

AssamSip is owned and operated by Dhrubajyoti Borthakur, registered under GST in Assam, India. Our business follows the Indian Contract Act, 1872, the Sale of Goods Act, 1930, and the Consumer Protection Act, 2019.

All agreements between you and AssamSip are governed by laws of India. Any legal disputes will be handled in courts of Dibrugarh, Assam. We do not have legal registration in any other country. If you order from outside India, you agree that Indian law applies.

We comply with Tea Board of India regulations for tea quality and labeling. Our garden is registered with Tea Board registration number available on request. We follow Food Safety and Standards Authority of India (FSSAI) rules for food products.

What You Agree to When Ordering

Accurate information: You must provide correct name, address, and phone number. If package cannot be delivered due to wrong address, reshipping cost is your responsibility. We verify phone numbers before dispatch - if we cannot reach you, order may be delayed.

Payment on time: You agree to pay 50% advance within 48 hours of quote. Remaining 50% due before shipping. If payment not received within agreed time, we may cancel order and advance is non-refundable unless we confirm cancellation in writing.

Minimum orders: CTC grade minimum 5 kg, Orthodox grade minimum 2 kg. We cannot process smaller quantities. Sample pack is fixed at 450 grams total. Wholesale customers have different minimums as discussed separately.

Quality expectations: Tea is natural agricultural product. Color and taste may vary slightly between batches depending on weather and harvest timing. Small variations normal and not ground for refund. Photos on website are representative only.

Proper storage: Once delivered, you must store tea in airtight container away from moisture and strong smells. We are not responsible for quality issues if tea stored improperly after delivery. Best consumed within 18 months of packing date.

Inspection at delivery: Check package condition immediately upon receipt. If box damaged or torn, photograph before opening and inform us within 24 hours. Claims for transit damage not accepted after 24 hours.

How We Handle Disagreements and Problems

Step 1 - Direct discussion: If you have complaint about tea quality, delivery, or service, email contact@assamsip.com with order number and photos. Pranav Borthakur will respond within 48 hours with proposed solution. Most issues resolved at this stage.

Step 2 - Owner review: If unsatisfied with Pranav's response, request escalation to Dhrubajyoti Borthakur (owner). He will personally review your case within 5 business days and provide final decision. His decision is binding for our business.

Step 3 - Mediation: For disputes above ₹10,000 value that cannot be resolved through direct discussion, we agree to attempt mediation through Dibrugarh Chamber of Commerce before going to court. Mediation costs split equally between both parties.

Legal action: If mediation fails, any legal proceedings must be filed in District Court of Dibrugarh, Assam only. You cannot file suit in any other court in India or abroad. We both agree to this jurisdiction exclusively.

Time limits: Any legal claim against AssamSip must be made within 6 months of the issue occurring. After 6 months, we are not liable. This applies to quality complaints, delivery problems, or any other disputes.

Limitation of liability: Our maximum liability for any claim is limited to the amount you paid for that specific order. We are not liable for indirect losses, business losses, or consequential damages of any kind.

Business hours: Our office operates Monday to Saturday, 10 AM to 6 PM IST. Closed on Sundays and major Indian holidays. Processing and packing happens Tuesday and Friday regardless of holidays.

Changes to These Terms

We review and update these terms annually. Current version date shown at top of page. If we make significant changes, we will email customers who ordered in previous 12 months. Continued ordering after changes means you accept new terms.
